Let me bust some dangerous myths I hear constantly:

Myth 1: "If we don't store SSNs or credit cards, it's not PHI"

FALSE. I've seen apps get violations for storing:

  • Patient names with diagnosis codes

  • Appointment schedules with provider notes

  • Medication lists with patient identifiers

  • Fitness data linked to medical conditions

  • Even phone numbers when associated with healthcare context

Myth 2: "Encryption alone makes us compliant"

FALSE. I audited an app with perfect encryption but:

  • No access controls (any user could access any patient)

  • No audit logging (couldn't detect unauthorized access)

  • No incident response plan (didn't know what to do when breached)

  • No Business Associate Agreements (vendors could do anything with PHI)

They were breached. Encryption didn't matter when the attacker just logged in as a legitimate user.

Myth 3: "HIPAA only applies to healthcare providers"

FALSE. If you handle PHI for or on behalf of a covered entity, you're a Business Associate subject to HIPAA. This includes:

  • App developers building patient portals

  • Health coaches using apps to track client data

  • Researchers collecting health data with identifiers

  • Telehealth platforms connecting patients and providers

Myth 4: "We're too small for OCR to care about"

FALSE. I've seen enforcement actions against:

  • Solo medical practices

  • Two-person app development shops

  • Non-profit health organizations

  • University research projects

OCR investigates complaints regardless of organization size.

Myth 5: "De-identification means we can do whatever we want with the data"

FALSE. De-identification under HIPAA has specific requirements:

  • Expert determination method (statistical analysis)

  • Safe harbor method (removing 18 specific identifiers)

Just removing names isn't de-identification. I've seen apps think they were safe because they used user IDs instead of names. Those user IDs were still identifiers making the data PHI.

Blockchain and Decentralized Health Data: New architectures giving patients control over their health data will create novel compliance challenges around data persistence and the "right to be forgotten."

Final Thoughts: Is It Worth It?
